Border Patrol Arrests Previously Deported Child Sex Offender In Louisiana

“Release Date: February 15, 2019

LAKE CHARLES, La. –New Orleans Sector Border Patrol agents arrested a previously removed child sex offender early Friday morning in Lake Charles, La., after he was discovered illegally in the United States.

Lake Charles Border Patrol Station agents responded to a call for assistance from the Calcasieu Parish, La., Sheriff’s Office on a traffic stop on Interstate 10 near Sulphur Springs, La. Upon arrival, agents determined that one of the three passengers, Heber Obed Hernandez-Martinez was a convicted sex offender and aggravated felon who had been convicted in 2009 of a First Degree Sexual Offense involving a child and served 84 months in confinement. He was subsequently removed from the United States in August 2016.

“This significant arrest of an illegal alien felon convicted of a serious sexual offense involving a child highlights the fact that bad people and bad things do come across our border as part of the migrant caravan. Although not all members of the caravan are aggravated felons, the Border Patrol understands that some will exploit the caravan to do harm to the United States and its citizens,” said New Orleans Sector Chief Patrol Agent Greg Bovino. “Border Security is National Security and doesn’t just occur at the physical border. If the Border Patrol and local partners like Calcasieu Parish didn’t have a robust enforcement posture in place, Hernandez may have had the opportunity to assault another child.”

Hernandez will remain in federal custody to face possible felony immigration charges in Louisiana since he was found in the country after removal without being lawfully admitted. Federal law allows agents to charge individuals by complaint, a method that allows the filing of criminal activity charges without inferring guilt. An individual is presumed innocent unless and until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.

U.S. Customs and Border Protection welcomes assistance from the community. Individuals can report suspicious activity to Border Patrol by calling (504)-376-2800. All calls will be answered and remain anonymous.”

Supreme Court Turns Away Environmentalists Trying To Stop Border Wall Construction

Another victory for national security & the border wall. This will help us as we continue the construction of our next projects if environmentalists come after us as they did at Project 2.

“The Supreme Court on Monday declined to hear an appeal from a coalition of environmental groups that pushed back against the Trump administration’s construction of the wall along the U.S.-Mexico border.

The groups, led by the Center for Biological Diversity, challenged a 1996 law giving the president authority to fight illegal immigration and border crossings, and limiting some legal challenges.

The coalition claimed that the Trump administration did not conduct sufficient environmental impact studies for the construction and that endangered species like the jaguar and Mexican wolf would be adversely affected by the barrier.

They had asserted in their case that the law’s allowance for the secretary of Homeland Security to waive any laws necessary to allow the quick construction of border fencing violates the Constitution’s separation of powers. The D.C. Circuit Court of Appeals had dismissed the case, citing a prior case from 2007 with “a nearly identical context.”

“This Court finds that precedent persuasive, and it compels the conclusion that Plaintiffs’ complaint fails to state plausible constitutional claims as a matter of law,” the Circuit Court’s ruling said.”
